This Privacy Policy (“Privacy Policy”) describes how ELEMENTIK TECHNOLOGIES PVT. LTD.(the “Company”, “we”, or “us”) collects, uses, stores, shares and protects your information in connection with your use of BYTESEAL, a password managing platform (“Platform”) developed and launched by the Company and the services Company may offer through the BYTESEAL from time to time

The Company is committed to maintain the privacy of its users whereby appropriate measures are taken to ensure that user's credentials are not misused, accidentally destroyed or lost within the environment of the platform.

By using Byteseal, either in its free or paid version, and signing up with us, you agree to our Terms and Conditions and Privacy Policy. Further, by sharing your details with us, you also agree to receive e-mails including newsletter, campaign updates, advertisements, inter-alia with regard to our services by us.

If You Do Not Agree To Be Bound By This Agreement You May Not Access Or Use The Portals.

 

 

What this Privacy Policy Covers

  • This Privacy Policy covers our usage of material as mentioned in the policy that is shared by you on our Cloud-Service Platform, in case of the free version of Byteseal, and the biometric secured software and product, in case of the paid version. This policy also covers treatment of any personally identifiable information shared with us.

  • This policy does not apply to the activities of organizations not owned or controlled by us, or to people who are not employed or managed by us.

The Company is committed to the protection of the privacy of its Users. We use and process your personal data in accordance with the General Data Protection Regulation (GDPR). The GDPR is short for the Regulation (EU) of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data (General Data Protection Regulation). This European regulation provides the highest level of privacy protection in the world. That is why we apply this high standard to all Users.

What Information do we collect?

  1. Non-Personally Identifiable Information:

We collect non-personally identifying information that your browser makes available whenever you visit a Platform. This information includes your IP Address and hardware specs, browser type, browser language, the date and time of your query and one or more cookies that may uniquely identify your browser.

         2. Personally Identifiable Information:

We collect information you provide when you create an account or register with us, enrol for a service, use a service, submit your profile as required by the Platform, subscribe to our mailing lists, send us an e-mail or call us. Moreover, since Byteseal provides the service of a credential manager which protects users’ passwords and other personal information, the users should acknowledge that these passwords would also be collected and stored by us, in order to enhance user’s security however these passwords or any other credentials will not be shared by us with any person or institution without the user’s consent. The information may also include but is not limited your name, your e-mail address and your phone number. The details of your Credit or Debit Card may be required and saved upon acquiring your permission while availing the Paid Version of the Platform

        3. Location Data:

We receive information from you that helps us approximate your location. We may, for example, use an address submitted by you while setting up your profile, IP Address or hardware MAC address received from your browser or device to determine your approximate location. We may also collect location information from devices in accordance with the consent process provided by your device.

Additionally, and only upon your grant of respective permissions we may collect information from third party service providers.

What do we use your information for?

Any of the information we collect from you may be used in one of the following ways:

  1. To personalise your experience and update your account: Your information helps us to better respond to your individual needs.

  2. To improve our services: We provide the service of password protection for the users in forms of: Cloud service, in case of a free version, and in case the user opts for the paid version, we provide biometric security provided by user’s smartphones, and also a separate biometric authentication device which eliminates the vulnerabilities associated with the smartphone biometrics. We continually strive to improve services for protecting user’s passwords and through the storage of such sensitive information, we would be able to enhance the level of protection and efficacy of our services.

  3. To improve customer service: Your information helps us to more effectively respond to your user service requests and support needs both in terms of the cloud based platform, as well as the hardware.

  4. To send periodic emails: The email address as provided by you, may be used to send in information and updates pertaining to your programme, in addition to receiving occasional Company news, updates, related service information, etc. to be able to tailor the Services to one’s specific needs if feasible, for convenience of users and communication with them, and as may be required by law.

How do we protect your information?

 

We implement a variety of security measures to maintain the safety of your personal information when you enter, submit, or access your personal information.

While we carefully select the other Platforms we link to, we are not liable for the privacy practices or content of such Platforms. In case of the paid version, there is a provision of biometric security, and the hardware for password protection, we disclaim any and all liability with regard to the use and setting up of biometrics via the hardware device; and if the same is accessed by any third-party for setting up of its bio-metric and accessing the User’s account with BYTESEAL, thereby, we would not be liable in case of potential breaches by third-parties.

 

When does Company disclose Information?

We reserve the right to disclose personally identifiable information and/or non-personally-identifiable information that we believe, in good faith, is appropriate or necessary to enforce its terms of use, take precautions against liability, to investigate and defend itself against any third-party claims or allegations, to assist government enforcement agencies, to protect the security or integrity of our Platform, and to protect the rights, property, or personal safety of the Company, our Users or others.

 

Do we disclose any information to outside parties?

 

  1. We do not sell, trade, or otherwise transfer to outside third parties, your personally identifiable information, unless, such transfer is essential.

  2. This does not include trusted third parties who assist us in operating our cloud based services, and biometric based hardware, conducting our business, or servicing you, so long as those parties agree to keep this information confidential.

  3. We reserve the right to disclose personally identifiable information and/or non-personally-identifiable information that it believes, in good faith, is appropriate or necessary to enforce its Terms of Use, take precautions against liability, to investigate and defend itself against any third-party claims or allegations, to assist government enforcement agencies, to protect the security or integrity of our services, and to protect the rights, property, or personal safety of the site, our Users or others.

  4. We may use and disclose to third parties, information we collect in aggregated, non-personally identifiable form for research and informational purposes and to help us make sales, marketing and business decisions for marketing, advertising, or other uses.

  5. We may provide limited contact, payment and usage information to companies that provide services to help us with our business activities such as our live chat customer support or analytics provider. These companies are authorized to use such information only as necessary to provide these services to us.

 

Change of control:

In the event of the change of control of Company or a business transition, such as, reorganization, merger, acquisition, or sale of assets, your information may be transferred to the successor organization. You will be notified of any such deal and your information would remain subject to the commitments contained in this Privacy Policy until such time as this Privacy Policy is updated or amended by the acquiring party upon notice to you.

 

 

 

 

Information Storage

 

  1. Permission to Use Information: By submitting your personal information, you agree to its transfer, storage or processing. We will take all steps reasonably necessary to ensure that your data is treated securely and in accordance with this Privacy Policy.

Data Retention: The data provided by you is retained by us in our database for our personal records, and future communication purposes even after you cease to use the services or access to the Platform. We take sufficient security measures to protect data provided by you from any misuse or any other security concerns.

  3. Password: Where we have given you (or where you have chosen) a password which enables you to access certain Services, you are responsible for keeping this password confidential. We ask that you do not share your password with anyone. The User solely shall be responsible for the use and setting up of biometrics via the hardware device; we shall not be liable if the same is accessed by any third-party for setting up of its bio-metric and accessing the User’s account with BYTESEAL. We shall not be, in any way, liable for the potential breaches by third-parties and the intrusion and/or the leakage of the user passwords. Disclaimer: Unfortunately, the transmission of information via the Internet is not completely secure. Although we will do our best to protect your personal data, we cannot guarantee the security of your data transmitted to us via the Internet; any such transmission is at your own risk.

 

DISCLAIMER OF LIABILITY

Company does not guarantee an error-free performance under this Privacy Policy. We may not always catch an unintended privacy issue, despite our reasonable efforts to do so. Accordingly, we welcome your feedback regarding any privacy concerns that you may have, including how we can improve this Privacy Policy. We will use reasonable efforts to comply with this Privacy Policy and will take prompt corrective action when we learn of any failure to comply with it.

Thorough care has been taken in the protection of information on the Platform, however, we will not be responsible and shall not accept any liability for loss incurred in anyway whatsoever, by anyone who may seek to depend on the information contained herein.

 

Modification and Deletion of Personally Identifiable Information

Deletion: In order to delete the personally identifiable information including but not limited to various passwords that you submitted, you can notify us that you wish to delete your personally identifiable information or any part thereof contained at our databases.

Modification: If you wish to modify or update your personally identifiable information, use the application interface.

Please note that deletion of your personally identifiable information from the Company’s database will not prevent us from using gathered anonymous information.

 

Third party links

Occasionally, at our discretion, we may include or offer third party products or services along with our services and products. These third-parties sites have separate and independent privacy policies. We therefore have no responsibility or liability for the content and activities of these linked third-parties. Nonetheless, we seek to protect the integrity of our product and services, and welcome any feedback about these.

 

Minors’ Online Privacy Protection

The Platform are intended for the general audience, individuals and userswhereby Parent(s) or guardian(s) of the user below the age of 18 years shall be liable for all and any acts of such user using the Portals provided by us.

 

Online and Offline Privacy Policy Only

This online privacy policy applies not only to the information collected through our Cloud based services, but also the information collected through the biometric enabled hardware device.

Your Consent

By using our services, and product, you consent to our privacy policy. You have the right to withdraw that consent at any time. However, this will not affect the lawfulness of processing based on your prior consent.

Changes to our Privacy Policy

If we decide to change our privacy policy, we will update you notifying you of any changes.

Your Rights

 Depending on the applicable law you may have the following rights in relation to your personal data:

  1. Right to access your personal data being processed by us

  2. Right to rectify any discrepancy, inaccuracy in your personal data or complete any incomplete details

  3. Right to delete or remove your personal data in certain circumstances

  4. Right to restrict or object to processing of your personal data in certain circumstances, such as where the accuracy of personal data is disputed

  5. Right to withdraw your consent
